Use of the NCP site includes accessing, browsing or registering to use the NCP site. CHANGES TO THE NCP SITE

NCP may update the NCP site from time to time, and may change the content at any time. However, please note that any of the content on the NCP site may be out of date at any given time, and NCP is under no obligation to update it.

NCP does not guarantee that the NCP site, or any content on it, will be free from errors or omissions.

YOUR ACCOUNT AND PASSWORD

If you choose, or you are provided with, a user account, password or any other piece of information as part of our registration or security procedures, you must treat such information as confidential. You must not disclose it to any third party. In setting up your user account, you may be prompted to enter additional optional information (e.g., your address). You represent that all information provided by you is accurate and current. You agree to maintain and update your information to keep it accurate and current.

NCP has the right to disable any user account or password, whether chosen by you or allocated by NCP, at any time, if in NCP's reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user account or password, you must promptly notify NCP at info@ncp.gov.sa

ACCESSING THE NCP SITE

NCP does not guarantee that the NCP site, or any content on it, will always be available or be uninterrupted. The NCP also do not guarantee that any content on the NCP site will always be provided in both the Arabic and English languages.

Access to the NCP site is permitted on a temporary basis. The NCP may suspend, withdraw, discontinue or change all or any part of the NCP site without notice. The NCP will not be liable to you if for any reason the NCP site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the NCP site.

You are also responsible for ensuring that all persons who access the NCP site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

NCP makes no representation that the content on this site is appropriate or available for use in jurisdictions/locations outside KSA. NCP may limit the availability of the NCP site or any service described on the NCP site to any person or geographic area at any time. If you choose to access the NCP site, you do so at your own risk.

NO RELIANCE ON INFORMATION

Nothing in these terms of use excludes or limits NCP's liability for death or personal injury arising from NCP's negligence, or NCP's fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by the laws of the Kingdom of Saudi Arabia.

To the extent permitted by law, NCP excludes all conditions, warranties, representations or other terms which may apply to the NCP site or any content on it, whether express or implied.

NCP will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, the NCP site; or
  • use of or reliance on any content displayed on the NCP site.

You agree that you will use the NCP site in compliance with these terms of use and all applicable local, national and international laws, rules and regulations, including copyright laws and any laws regarding the transmission of technical data exported from your country of residence. You warrant that any such use does comply with those standards, and you will be liable to NCP and indemnify NCP for any breach of that warranty. This means you will be responsible for any loss or damage the NCP suffers as a result of your breach of warranty.

NCP will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the NCP & PPP site or to your downloading of any content on it, or on any website linked to it.

NCP assumes no responsibility for the content of websites linked on the NCP site. Such links should not be interpreted as endorsement by the NCP of those linked websites. NCP will not be liable for any loss or damage that may arise from your use of them.

VIRUSES

NCP does not guarantee that the NCP site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access the NCP site. You should use your own virus protection software.

You must not misuse the NCP site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the NCP site, the server on which the NCP site is stored or any server, computer or database connected to the NCP site. You must not attack the NCP site via a denial-of-service attack or a distributed denial-of-service attack. The NCP will report any breach of this provision to the relevant law enforcement authorities and the NCP will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the NCP site will cease immediately.

LINKING TO THE NCP SITE

You may link to the NCP home page, provided you do so in a way that is fair and legal and does not damage the NCP reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on the NCP's part where none exists.

You must not establish a link to the NCP site in any website that is not owned by you.

The NCP site must not be framed on any other site, nor may you create a link to any part of the NCP site other than the home page.

NCP reserves the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with these terms of use.

NCP has no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

INDEMNIFICATION

You agree to defend, hold harmless and indemnify NCP and the NCP subsidiaries, affiliates, officers, governing board members, agents and employees from and against any third-party claims, actions or demands arising out of, resulting from or in any way related to your use of our site, including any liability or expense arising from any and all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, NCP will provide you with written notice of such claim, suit or action.

SUSPENSION AND TERMINATION

NCP will determine, in NCP's discretion, whether there has been a breach of these terms of use through your use of the NCP site. When a breach of this policy has occurred, the NCP & PPP may take such action as the NCP & PPP deems appropriate.

Failure to comply with the terms of use may result in NCP taking all or any of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use the NCP site;
  • issue of a warning to you;
  • legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  • further legal action against you; and
  • disclosure of such information to law enforcement authorities as NCP reasonably feels is necessary.

NCP excludes liability for actions taken in response to breaches of the NCP terms of use. The responses described in this policy are not limited, and NCP may take any other action NCP reasonably deems appropriate.

APPLICABLE LAW

These terms of use, its subject matter and its formation (and any non-contractual disputes or claims), are governed by the laws of the Kingdom of Saudi Arabia. NCP agrees that the courts of the Kingdom of Saudi Arabia will have exclusive jurisdiction.

TRADE MARKS

All trademarks not owned by NCP that appear on the NCP site are the property of their respective owners. You may not use any of these trademarks, or any variations thereof, for promotional purposes, in any way that deliberately or inadvertently claims, suggests or, in the sole judgment of the respective owner of the trademark, gives the appearance or impression of a relationship with or endorsement by these institutions.

Nothing contained on the NCP site should be construed as granting, by implication, estoppel or otherwise, any licence or right to use any trademark displayed on the NCP site without the written permission of the owner of the applicable trademark.
